A woman lost her life and another was injured on Saturday, October 22 just before 5:30 a.m. in a hit-and-run accident near the corner of Outer Loop and Grade Lane in Louisville, Kentucky.

According to Louisville Metropolitan Police Department spokeswoman Alicia Smiley, the two women were riding in a Dodge Caliber westbound along the Outer Loop when a Volkswagen Jetta turning onto the road from Grade Lane collided with their vehicle. This incident caused the two women to get out of their vehicle. As they were standing near their car and surveying the damage the collision brought on, a Chevrolet 1500 pickup truck headed east on Outer Loop crashed into the two women and their vehicle. The driver of the pickup truck left the scene of the accident. One of the women died because of her mortal injuries at the scene while the other woman was transported to the University of Louisville Hospital for treatment of her injuries of an unknown nature.

The Louisville Metropolitan Police Department is asking the public who may have information regarding the incident to contact them by calling 574-LMPD (5673).

Supreme Court favors woman who sues Louisville hospital

Nearly a quarter of a decade ago, Wanda Johnson was the victim of a truck accident and faced traumatic injuries to her spine, pelvis, and brain. She was initially hospitalized in Louisville, Kentucky and after a month was moved to another hospital to continue her treatment.

Her condition upon arrival began to deteriorate and she filed a lawsuit against the original hospital for damages in accordance with the Emergency Medical Treatment and Active Labor Act when the first hospital apparently didn’t use the proper screening procedures before transferring her to another facility.

When she lost the summary judgment and then was rejected by the Court of Appeals, she made an appeal to the Supreme Court of the United Sates. The ruling was that the EMTALA provision does not require a showing of improper motive on the part of the medical facility for the plaintiff to be able to sue it; it does not demand an “appropriate stabilization, nor can it be reasonably read to require an improper motive.”

If you had been in an accident and then were further hurt by the medical staff that you in Louisville or other areas in Kentucky, you have found the legal defenders who are willing and able to take on these purveyors of unnecessary and inconvenient plight. One dead and one hurt in Louisville single-vehicle accident

Posted on Wednesday, October 5th, 2016 at 8:42 pm

One individual lost her life and another sustained minor injuries after a single-vehicle accident, which occurred around 11 p.m. last Sunday, October 2. The accident happened as the driver attempted to use the ramp at Gene Snyder heading northbound to merge onto Interstate 64 East in Louisville.

The coroner identified the deceased victim as 28-year-old Jessica Smith, who was driving at the time of the accident. According to preliminary investigations, Smith lost control of the wheel, causing the vehicle to flip over. In the process, Smith and her male passenger were both thrown out of the vehicle. Police officers noted that neither the driver nor the passenger had a seat belt securing them at the time of the incident. They flipped and hit the guardrail on the interstate. Smith’s passenger is receiving treatment at University Hospital.

At the Sampson Law Firm, we see tragic accidents such as this one far too often. Our condolences are with the family of the victim as they mourn the loss of their loved one.
